These Terms of Service (“Terms”) govern your use of the Koru Wellness platform (“Platform”, “Service”, “Koru”), including our WhatsApp mental health support system, mobile application, and professional counseling services, operated by Koru Wellness (Pty) Ltd (“Company”, “we”, “us”, or “our”).
1. ACCEPTANCE OF TERMS
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
You must be at least 13 years old to use our Service. Users under 18 must have parental or guardian consent to use our Service.
2. DESCRIPTION OF SERVICES
Koru Wellness provides mental health support through multiple channels:
a) WhatsApp Mental Health Support: Daily wellness messages, coping strategies, and crisis support information delivered via WhatsApp.
b) Mobile Application: Personalized mental health tracking, adaptive content delivery, and interactive therapeutic tools.
c) Professional Counseling Services: One-on-one sessions with licensed mental health professionals via video, phone, or secure messaging.
d) Corporate Wellness Programs: Workplace mental health solutions including crisis intervention and employee support.
3. IMPORTANT LIMITATIONS
3.1 Not Emergency Services Koru Wellness is not an emergency service or crisis intervention service. If you are experiencing a mental health emergency or are in immediate danger, contact your local emergency services (10111) or crisis hotline immediately.
3.2 Not Medical Treatment Our Service provides mental wellness support and educational content but does not constitute medical advice, diagnosis, or treatment. Always seek the advice of qualified healthcare providers with questions regarding medical conditions.
3.3 Professional Counselor Relationships When you engage with our professional counselors, you enter into a separate therapeutic relationship with that individual professional. Koru Wellness facilitates these connections but does not direct or control the provision of professional mental health services.
4. USER RESPONSIBILITIES
You agree to:
a) Provide accurate and complete information when creating your account
b) Use the Service only for lawful purposes and in accordance with these Terms
c) Maintain the security of your account credentials
d) Respect other users and maintain appropriate behavior in group settings
e) Immediately seek professional help if you experience thoughts of self-harm or suicide
5. PRIVACY AND CONFIDENTIALITY
We are committed to protecting your privacy and maintaining strict confidentiality of your personal health information. Our privacy practices are governed by: a) South African Protection of Personal Information Act (POPIA) b) Professional ethics guidelines for mental health practitioners c) International best practices for healthcare data protection

6. PAYMENT AND SUBSCRIPTION TERMS
6.1 Service Tiers Koru Wellness offers multiple pricing tiers:
a) WhatsApp Basic: Monthly subscription starting at RXXX/month
b) App + Tracking: Monthly subscription starting at RXXX/month
c) Professional Counseling: Per-session fees starting at RXXX/session d) Psychologist Counseling: Additional fees apply subject to individual psychologist rates e)
Corporate Programs: Custom pricing based on organization size and needs
6.2 Additional Services Additional services and premium features may be offered at additional cost. All additional fees will be clearly disclosed and billed upfront before service provision.

7. INTELLECTUAL PROPERTY
7.1 Platform Content All content, features, and functionality of the Service are owned by Koru Wellness and are protected by South African and international copyright, trademark, and other intellectual property laws.
7.2 User Content You retain ownership of content you submit to the Service. By submitting content, you grant us a limited license to use that content to provide and improve our services.
8. PROHIBITED CONDUCT
You may not:
a) Use the Service for any unlawful purpose or to solicit unlawful activity
b) Impersonate another person or entity
c) Interfere with or disrupt the Service or servers
d) Attempt to gain unauthorized access to any portion of the Service
e) Share inappropriate, harmful, or offensive content
f) Violate any applicable laws or regulations
9. TERMINATION
9.1 Termination by You You may terminate your account at any time by contacting us or through your account settings.
9.2 Termination by Us We may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms or engage in prohibited conduct.
10. DISCLAIMERS
10.1 Service Availability We strive to provide continuous service but cannot guarantee uninterrupted access. The Service is provided “as is” and “as available.”
10.2 Professional Services While our counselors are licensed professionals, we cannot guarantee specific outcomes from therapeutic interventions.
11. LIMITATION OF LIABILITY
To the maximum extent permitted by South African law: a) Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim b) We are not liable for indirect, incidental, or consequential damages c) We are not liable for actions or omissions of third-party counselors
12. INDEMNIFICATION
You agree to indemnify and hold harmless Koru Wellness from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
13. GOVERNING LAW
These Terms are governed by the laws of South Africa. Any disputes will be resolved in the courts of South Africa.
14. CHANGES TO TERMS
We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify users of material changes via email or platform notification.

16. SEVERABILITY

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Koru Wellness regarding the Service.
